Former New York Yankees player Brett Gardner's son Miller died on March 21 the family was vacationing in Costa Rica, and the investigation is still ongoing. According to a new report from ESPN, the investigation has been handed over to a local prosecutor's office, which is working to determine whether Miller's death was a "natural or homicidal."

Miller died while the Gardner family was on vacation in Costa Rica, and local investigators previously said there were "high levels of carbon monoxide contamination" found in his hotel room. Gardner, the 41-year-old former New York Yankees player, announced his son's death in a social media post, saying he and wife Jessica "have so many questions and so few answers," adding that they understood he "passed away peacefully in his sleep" during the trip.

More than two months after the incident, the case remains open. ESPN reported Friday morning that a spokeswoman with the Prosecutor's Office of Costa Rica said that they are still working "to determine whether the cause of death was a homicide or not, and if so, to establish responsibility."

The spokeswoman added that "the aim is to determine whether it was a natural or homicidal death." PEOPLE reached out to the spokeswoman for more information but did not receive a response. PEOPLE has also reached out to the Costa Rica Judicial Investigation Agency, who previously handled the death investigation before it was turned over to the local prosecutor's office.
